Question:
Is it obligatory to repeat the Hajj for one who had intercourse before the first release, given that his Hajj was a voluntary one?

Answer:
If one has intercourse before the first release, his Hajj becomes invalid. If he has intercourse before performing the circumambulation and shortening the hair, his Hajj becomes invalid. He must complete it, completing it in a state of invalidity, and then make it up afterwards. Even if he performed a voluntary Hajj, he must make it up afterwards by completing it in a state of invalidity and then making it up. This is what the Companions of the Prophet (peace and blessings be upon him) issued a ruling on. He must also sacrifice a camel or cow, slaughter it, and distribute it to the poor and the needy.
