If a person is insolvent, are his assets sold?
The judges examine the case and rule according to his circumstances. If he is insolvent, he is not restricted; for Allah said:
And if someone is in hardship, then [let there be] postponement until [a time of] easeوَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍ
[Surat al-Baqarah: 280]. However, if he has wealth from which he can pay, he is restricted until he settles the debt he owes.
