Question:
The first message in this episode is from one of our female listeners. The sender, (S. F.), says: “Sister, we presented some of her questions in a previous episode, and in this episode she asks your Eminence and says: My father married a woman and divorced her after she had given birth to a daughter. Then he sent her the divorce certificate, and he was desirous of parting with her and had forgiven her. However, her family said that he had not divorced her except with one divorce, which is the divorce in the certificate; because when he divorced her, she was at her family’s home. After five years, my father went to propose for my brother a woman from the village where my father’s wife was. My father’s wife’s father said to my father: If you want to take back your wife, take her back. So my father took her back and gave her a new mahr (bridal gift). She is now with my father and under his protection. I ask for guidance: Is this action valid? Knowing that when my father divorced her, she was visiting her family, and he did not speak to her; rather, he divorced her in the presence of the shaykh, and he was desirous of parting with her. He also sent with the certificate a paper asking her father to marry her off if someone came to ask for her hand. May Allah reward you with good.”
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
Your father should go back to the court to ask them about what is unclear to him, or he should contact me so that I can understand what happened, and then I will inform him of what is obligatory. We ask Allah for success for everyone. Yes.
The presenter : May Allah reward you with good, and may He do you good.
