Discussion of two narrations that appear to differ regarding the issue of starting with the right-hand side in drinking.

Machine translationRead the Arabic original
The questioner : ... Abd al-Rahman, what is mentioned ... is only in the chapter.

The Shaykh : Give me the two books or the two narrations.

The questioner : Please, our Shaykh.

The Shaykh : Does it mean ... He said, "I heard Anas."

The questioner: Yes.

The Shaykh : He says:
The Messenger of Allah (peace and blessings be upon him) was in our house and asked for water. كان رسول الله في دارنا فاستسقى
.

The questioner: Yes.

The Shaykh : This is Anas's narration.

The questioner: Yes.

The Shaykh : Okay, where is the second narration?

The questioner : Also from Anas, my Shaykh, which is the chapter on drinking milk, yes, it is in front of you.

The Shaykh : It is not this one.

The questioner: Yes.

The Shaykh : This is one narration.

The questioner : I told him this, and he asked, "Who told you that?" He said to me, "This is an incident and this is an incident."

The Shaykh : What told you that Anas is narrating the story? Anas.

The questioner: Yes.

The Shaykh : One person is the one narrating the story.

The questioner: Yes.

The Shaykh : How does he know? I mean, a man, O ignorant one, O feigning ignorance.

The questioner: Yes.

The Shaykh : Because who told you? The story revolves around Anas ibn Malik.

The questioner: Yes.

The Shaykh : A concise narration and a detailed narration.

The questioner: Yes.

The Shaykh : So, the one who says "Who told you?" has knowledge of the principles of jurisprudence; they use a term they call ... what is it? An absolute term.

The questioner: Yes.

The Shaykh : And a restricted term.

The questioner: Yes.

The Shaykh : Like the general and the specific, when you say this is a general text specified by a text that specifies it.

The questioner: Yes.

The Shaykh : He tells you: Who told you? My brother, these are scientific principles of jurisprudence.

The questioner: Yes.

The Shaykh : I think, and Allah knows best, that he is not a scholar.

The questioner : I mean, in my opinion, my Shaykh, he is a preacher who memorizes some texts.

The Shaykh : The point is, this is a narration from Anas.

The questioner: Yes.

The Shaykh : One is concise and one is detailed.

The questioner : Meaning, one is general and one is specific.

The Shaykh : Yes.

The questioner: Yes.

The Shaykh : So when he asks you, "Who told you?" My brother, the narrator is one, and the narrators differ. For example, a story is narrated on a full page from a Companion.

The questioner: Yes.

The Shaykh : The same story is narrated from this Companion in half a page, or a quarter, or in a single sentence. It is not said, "Who told you?" We know that the Companion narrator is one person.

The questioner: Yes.

The Shaykh : But the narrators who narrated the story from him differ in their memorization and differ in presenting the story on one occasion or another. For example: I want to cite from the story of the conquest of Khaybar, the conquest of Makkah, and the Treaty of Hudaybiyyah, and so on. So I take a piece of it and narrate it.

The questioner: Yes.

The Shaykh : Why? Because the situation I am in requires me to answer with this story, and that is permissible.

The questioner: Yes.

The Shaykh : It is permissible for another person to bring this and more. It is not said, "Who told you that this is the story?" This is a very obvious matter among scholars.

The questioner : I, my Shaykh, did a comparison for him. I said, "Here is an Arab, here is an Arab, here is Abu Bakr on his left, and here is Abu Bakr on his left, and here ... a situation of drinking milk, and here a situation of division." But he said, "He does not know," meaning it seemed to me that he entered into a real argument here.

The Shaykh : In any case, I wanted to draw your attention.

The questioner: Yes.

The Shaykh : To something I always mentioned.

The questioner : Yes, Shaykh.

The Shaykh : Now, this is where you are not opening to our hadith.

The questioner: Yes.

The Shaykh : We will see that in both hadiths, the cup was taken and drunk from by Abu Bakr on his left and an Arab on his right, so he gave the Arab. Here, what do we say? We say the Messenger (peace and blessings be upon him) was the one started with, and regardless of why he was started with for now.

The questioner: Yes.

The Shaykh : We say he was started with because he had asked for water.

The questioner: Yes.

The Shaykh : We always say, and this is a very strong argument, that the Messenger (peace and blessings be upon him) drank and there remained in the bottom of the cup the leftover.

The questioner: Yes.

The Shaykh : The Arab was on his right and Abu Bakr on his left. The Messenger (peace and blessings be upon him) is now the one serving; he is now the one serving. So if the rule of starting with the best applied, he would not have consulted the Arab who is on his right.

The questioner: Yes.

The Shaykh : So, on the contrary, he gives to Abu Bakr on his left, while the Arab asked for permission.

The questioner: Yes.

The Shaykh
He said: No, no, I prefer no one over ... قال : لا لا أوثر أحدًا على ...
So he gave to whom? The Arab. Why? He preferred the Arab over the best one because he is the right-hand one.

The questioner: Yes.

The Shaykh : Then he established this rule in his saying:
The right-hand one, then the right-hand one. الأيمن فالأيمن
.

The questioner: Yes.

The Shaykh : This is a conclusive argument.

The questioner : My Shaykh, Allah knows I mentioned this to him. I said to him, "Why does he not give to Abu Bakr based on the rule of the best?" He replied to me, "I agree with you that the right-hand one is given after the one who asked for water."

The Shaykh : We did not differ. The Messenger (peace and blessings be upon him) is now the one serving. The Messenger (peace and blessings be upon him) is now the one serving. So with whom does the one serving start? With the right-hand one or the best one? He says, "No, with the best one." The best one is Abu Bakr. Why did he not start with him?

The questioner : My Shaykh, now the issue of accepting texts with a specific mindset is his mindset, not his mindset in this matter. He does not comprehend this speech, my Shaykh.

The Shaykh : O Allah, guide us among those You have guided. Abu Abd al-Rahman, when did you arrive?
The student : By Allah, it has been two or three days.

The Shaykh : Welcome, how are you?
The student : How are you?
Another student: There is a need for a mosque. If any of your acquaintances wants a mosque from the locals, or otherwise, I do not think the state will provide for them.

The Shaykh : I will think about the matter, if Allah wills. Where are you ... .
The student : ... .

The Shaykh : And upon you be peace and the mercy of Allah and His blessings. Welcome.
The student: Peace be upon you.

The Shaykh : And upon you be peace, and the mercy of Allah and His blessings.
The student: Peace be upon you.

The Shaykh : And upon you be peace. Yes, yes.
The student: Peace be upon you.

The Shaykh: And upon you peace.
The student : One day I will answer ... .

The Shaykh : Meaning, you want to come.
The student : ... .

The Shaykh : You must call me by phone.
The student : With Allah's permission.
Another student: Peace be upon you.

The Shaykh : Close the door.
