The Shaykh Shuqara’s remarks on the position of Ibn Taymiyyah and Ibn al-Qayyim regarding the triple divorce.

Machine translationRead the Arabic original
Shuqara: Our Shaykh, a comment on the question. There is a note regarding the topic of divorce; specifically, regarding the triple divorce, Ibn Taymiyyah (may Allah have mercy on him), Ibn al-Qayyim, and those who mention their position in this specific matter, meaning divorce, are severe in their criticism of those who say that divorce is when you say, “You are divorced three times.” They hold that the triple divorce is when a man divorces his wife three times within her waiting period, divorcing her before her waiting period ends. This is the triple divorce that the Lawgiver prohibited, and it does not take effect because it is for a single waiting period.

The Shaykh: Yes.
Shuqara: As for divorce using the wording of three, if a man from Mauritania, our Shaykh, divorced his wife a hundred times, saying, “You are divorced a hundred times,” and the man regretted it, he began to travel through the lands of Mauritania searching for someone to issue a ruling for him. Every one of them would drive him away, saying, “Go away, I cannot find a ruling for you,” until he came to a blind man who said to him, “I will take on 97 of the divorces for you, and you seek someone to cover the remaining three.” He said, “By Allah, this man is just, brave, strong, and a scholar. May Allah reward you with good.” So he began searching for someone who could do it, and he would say, “There is no one braver in Mauritania than this man, and I do not know of anyone who would take on 97 at once, while all the scholars of Mauritania did not take on three.”

The questioner : Regarding the issue of divorce, if a man wants to divorce his wife... and he intends to divorce her before the waiting period has passed... does the divorce take effect with sin, or does the divorce not take effect? May Allah bless you.
