I ask for an explanation of the saying of the Truthful One (Blessed and Exalted is He):
And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] womenوَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ
[Surat al-Nisa:3]... the verse?

Its meaning is that it is prescribed for a man to marry the orphan in his care if she is suitable for him, and he gives her her obligatory mahr and marries her in the Shari'ah manner, such as his orphaned cousin or his orphaned maternal cousin. It is prescribed for him to marry her if she desires him and agrees to it, and he must give her the customary mahr and not wrong her. If he fears that he will not fulfill the obligation and not be just in her rights because she is under his control, let him marry her to someone else and marry another woman so that he does not wrong her. Either he gives her her full right if she is satisfied with it, or he marries her to someone else. He should not be lenient and say, "This is my orphan, and half the mahr is enough for her." No, that is not acceptable. She may be shy and not ask for it, but he must be just with her and give her her full right, or else let him marry her to someone else. If he does not marry her, he seeks another, for there are many women, and he has leeway in this. If he wishes, he may marry two, if he wishes, three, and if he wishes, four.
And this verse indicates that marrying two, three, or four is better, because Allah said:
marry those that please you of [other] womenفَانكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ
[Surat al-Nisa:3]. He did not say, "So marry one." He said:
then marry those that please you of [other] women, two or three or fourفَانكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ مَثْنَى وَثُلاثَ وَرُبَاعَ
[Surat al-Nisa:3]. This indicates that he chooses and considers, marrying two, marrying three, or marrying four, because in that is chastity for him and chastity for them as well. In that is also the seeking of children, for the presence of two, three, or four wives generally results in more children and more for the Ummah, along with his own chastity and the chastity of these women, whether two, three, or four. There are many benefits in marrying two, three, or four.
So it is not befitting for a sensible woman, and it is not befitting for a believer woman, to refuse that or to dislike it, praise be to Allah, if he is just with her and fulfills the obligation; praise be to Allah. But if he is unjust and wrongs her, she has the right to refuse and to demand justice. For this reason, He, the Exalted, said:
But if you fear that you will not be just, then [marry only] oneفَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً
[Surat al-Nisa:3]. If he fears that he will not fulfill the obligation, he is content with one, praise be to Allah.
But if a man has the capacity in his body and in his wealth to fulfill the rights of two, three, or four, the Sunnah for him is to have multiple wives, to be patient, and to fulfill the obligation, as the Prophet (peace and blessings be upon him) did. He had multiple wives (peace and blessings be upon him); he married nine in Madinah and combined nine wives. In Makkah, he had only Khadijah, then he married Sawdah and A'ishah after her, and then in Madinah he married the rest of his wives until they reached nine. And Allah says:
There has certainly been for you in the Messenger of Allah an excellent patternلَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ
[Surat al-Ahzab:21].
But the Ummah is limited to four. The Messenger (peace and blessings be upon him) limited the Ummah to four and ordered those who had a fifth or more to separate from the excess. When they embraced Islam, he ordered them to keep four and to separate from what exceeded four. So the Shari'ah settled on the fact that a man from the Ummah may combine four or fewer. As for the nine, this is specific to the Prophet (peace and blessings be upon him) and not for the Ummah; rather, this is among the specific characteristics of the Prophet (peace and blessings be upon him).
And if a man fears that he will not be just, he is content with one. And if he marries two, three, or four, it is obligatory for him to be just in division, maintenance, and what he is able to do in good treatment, kind words, pleasant demeanor, and good speech. He is to be just in that. As for love, that is up to Allah; it is not in his power for the love to be equal. And so intercourse is not in his power either, for intercourse follows love and follows desire. He strives for justice as much as possible, and Allah forgives what he is unable to do. In the authentic hadith, he (peace and blessings be upon him) said:
He used to divide among his wives and be just... He (peace and blessings be upon him) used to divide among his wives and be just, and he would say: "O Allah, this is my division in what I control, so do not blame me for what You control and I do not control."كان يقسم بين نسائه ويعدل.. كان يقسم ﷺ بين نسائه ويعدل، ويقول: اللهم هذا قسمي فيما أملك فلا تلمني فيما تملك ولا أملك
.
So the believer divides and is just according to his capacity, equalizing among them in his division, his face, his speech, his pleasant demeanor toward them, and his good treatment of them. As for love, that is in the hand of Allah, not in his hand. One may be dearer to him than another, but it is not permissible for that to lead him to injustice.
And so desire; he may desire one for intercourse more than another, and that does not harm him, because that is not by his choice and is not in his power. Rather, this follows love and desire. The obligatory justice is in the division: this one has a night, and this one has a night; this one has a day, and this one has a day. He spends on this one what is fitting for her, and on this one what is fitting for her and her children, each according to her situation. This one has two children, this one has three, this one has four. This one's garment is long, and this one is long, and this one is short. Each one has her sufficiency, yes, and the sufficiency of her children, yes.
