He asks Your Eminence another question, saying: What is the opinion regarding a debt that has passed a lunar year while it is with the debtor and I have not received it? Do I pay the zakah, or how should I handle it? May Allah reward you with good.
Answer: If the debt is owed by a person who is unable to pay, there is no zakah on it until you receive it. Likewise, if the debt is owed by a person who is delaying payment, and you demand your right but he does not give it to you, then there is no zakah on you until you receive it and it completes a new year with you. However, if the debt is owed by a wealthy person who is not delaying payment, and he gives it to you whenever you ask for it, then it is obligatory for you to pay the zakah. Once the lunar year has passed, you must pay the zakah, even if you have not received it; because it is like what is in your possession. As long as it is with a wealthy person who is not delaying payment, it is like what is in your possession, and the zakah is due on it once the lunar year has passed.
