Question:
This questioner (A. A) from Riyadh says: I lent a man a sum of money, and this amount has been delayed with him, and it is a full nisab. Do I have to pay zakah on it?

Answer:
If the one who owes the money is wealthy, such that when you ask for it he gives it to you, then you must pay zakah on it. But if he is unable to pay, or if he is delaying payment—meaning you ask for it and he does not give it to you—then you do not have to pay zakah on it, because you are not able to access it. However, if he is wealthy and not delaying, but you are the one being lenient, then you must pay zakah on it.
As for debts owed by those who are unable to pay, there is no zakah on them until you receive them. Likewise, for the one who delays payment, whom you ask for your right and he does not give it to you, you do not have to pay zakah on it until you receive it and a new lunar year begins. Yes.
