Ruling on the ablution of one who touches a woman

Machine translationRead the Arabic original
Does a man touching a woman’s hand with his hand, without any intention, affect their ablution or not?
Answer: Touching a woman involves a detailed ruling, and it has three cases: The first is that he touches her with desire; the second is that he does not touch her with desire, but it is an ordinary touch; and the third is the third opinion, which states that whether with desire or without desire, it does not harm. The correct view is that touching her does not invalidate the ablution, whether it is with pleasure or without pleasure; this is the correct view. As for His saying, the Exalted:
or you have contacted womenأَوْ لامَسْتُمُ النِّسَاءَ
[Al-Nisa: 43], the intended meaning is intercourse: “You have had intercourse with women.” So touching a woman, if he touches her, meaning for other than desire, does not invalidate the ablution. Likewise, if he touches her with pleasure, touching her hand or kissing her, it does not invalidate the ablution; his ablution is not invalidated by that. Aisha (may Allah be pleased with her) said:
The Prophet (peace and blessings be upon him) used to kiss her and then pray without performing ablutionإن النبي ﷺ كان يقبلها ثم يصلي ولا يتوضأ
Sunan ad-Daraqutni 1:449
.
The point is that kissing a woman or touching her hand, foot, or face does not invalidate the ablution, absolutely, according to the correct view, except if something comes out of him, such as pre-seminal fluid, in which case the ablution is invalidated. As long as it is just touching without anything coming out, the correct view is that this touching does not invalidate the ablution; based on the hadith of Aisha (may Allah be pleased with her):
He used to kiss some of his wives and then pray without performing ablutionكان يقبل بعض نسائه ثم يصلي ولا يتوضأ
May Allah send blessings upon him ....... . Yes.
The presenter: May Allah reward you with good and do you good.
