The Ruling on Ablution from Touching a Woman

Question:
Some people say: that touching a woman invalidates the ablution, and some of them say: if she is a small child, it does not invalidate it, meaning: if she is under seven years old. So what is the guidance of Your Eminence the Shaykh? May Allah reward you with good.

Answer:
The scholars differed regarding touching a woman: does it invalidate the ablution? There are three opinions:
The first is: that it invalidates the ablution absolutely, due to the generality of His saying (Exalted and Majestic is He):
or you have contacted womenأَوْ لامَسْتُمُ النِّسَاءَ
[Surat al-Nisa: 43], and they interpreted the touching as touching with the hand.
The second opinion is: that it invalidates the ablution if it is accompanied by desire and pleasure; because it is established that the Prophet (peace and blessings be upon him):
He used to touch his wives and not perform ablution, and he used to squeeze the feet of A'ishah until she would cover them while he was praying.كان يلمس نساءه ولا يتوضأ، وكان يغمز قدمي عائشة حتى تكفها وهو يصلي
This indicates that if it is without desire, it does not invalidate the ablution.
The third opinion is: that it does not invalidate the ablution absolutely. Touching a woman does not invalidate the ablution absolutely, whether with desire or without desire. And this is the stronger position, the correct one, that touching a woman does not invalidate the ablution in the strongest of the scholars' opinions; because the Messenger (peace and blessings be upon him):
He used to kiss some of his wives, then pray, and not perform ablution.كان يقبل بعض نسائه، ثم يصلي، ولا يتوضأ
And kissing usually occurs with pleasure.
So the conclusion is: that the correct view is that touching a woman does not invalidate the ablution, whether it is with pleasure and desire, or otherwise, except if pre-seminal fluid comes out of him, which invalidates the ablution; he washes his private part and performs ablution. But if he touched her with desire, or without desire, and nothing came out, then his ablution is valid and does not become invalid.
As for His saying (Exalted is He):
or you have contacted womenأَوْ لامَسْتُمُ النِّسَاءَ
[Surat al-Nisa: 43], in Surat al-Nisa and in Surat al-Ma'idah, the intended meaning is intercourse, an allusion to intercourse.
or you have touchedأو لامستم
meaning: you had intercourse. The intended meaning of touching with the hand is not the hand; the intended meaning is intercourse. And Allah alludes to intercourse by touching and by contact. This is the correct view. Yes.
