The question: This questioner, Abdullah from Tabuk, says: He pronounced triple divorce, saying: I pronounced triple divorce on the condition that I will not do a specific thing, such as abstaining from smoking, and then I went back to smoking. At that time, I wanted to abstain from it, and it was not my intention to divorce my wife; she is still with me in the house. Please advise us, may Allah reward you with good, and may you be rewarded?
The answer: If a man pronounces divorce on the condition that he will not drink intoxicants, or that he will not smoke, or that he will not speak to so-and-so, and his intention is to abstain from what he intended, and his intention is not to separate from his family, but rather his intention is to abstain from smoking, or drinking intoxicants, or speaking to so-and-so, or visiting so-and-so, then upon him is only the expiation for an oath; the divorce does not take effect. He must perform the expiation for an oath, and praise be to Allah, this is the correct opinion among the scholars. Yes.
