Exegesis of the saying of Allah the Exalted: {OR HAVE YOU TOUCHED THE WOMEN} [Surat al-Nisa: 43]

Machine translationRead the Arabic original
Question:
From Tabuk, one of the listening sisters says: Your sister in Allah (Maryam M. Z. J.) sent a collection of questions, one of which asks about the exegesis of the saying of Allah the Exalted:
or you have contacted womenأَوْ لَامَسْتُمُ النِّسَاءَ
[Surat al-Nisa: 43].

Answer:
The correct view is that its meaning is: intercourse,
OR HAVE YOU TOUCHEDلَامَسْتُمُ
: you had intercourse.
As for touching that does not involve intercourse—kissing her, or touching her with his hand—the correct view is that it does not invalidate the ablution; this is the relied-upon position.
The scholars have three opinions on this matter:
The first is that touching invalidates the ablution in all cases.
The second is that it invalidates it if it is done with desire, such as kissing her or touching her with desire.
The third opinion is that it does not invalidate it in all cases; touching does not invalidate it in all cases, whether he kissed her, or touched her hand, or a part of her body other than the hand. The correct view is that it does not invalidate the ablution if nothing comes out of him, if he does not discharge pre-seminal fluid or semen. For mere touching does not invalidate the ablution if nothing is discharged; because it is established that he (peace and blessings be upon him) kissed some of his wives and then prayed without performing ablution; and because Ibn Abbas and a group of scholars interpreted touching as intercourse.
So the correct view is that the touching referred to is: intercourse; because Allah (Mighty and Majestic) indicated the minor state of ritual impurity by His saying:
or one of you comes from the place of relieving himselfأَوْ جَاءَ أَحَدٌ مِنْكُمْ مِنَ الْغَائِطِ
[Surat al-Nisa: 43], this is the minor state of ritual impurity, then He indicated the major state of ritual impurity by His saying:
or you have contacted womenأَوْ لَامَسْتُمُ النِّسَاءَ
[Surat al-Nisa: 43], this contains an indication of the major state of ritual impurity, and the meaning is not the touching by hand mentioned by some of the scholars, which invalidates the ablution.
And by this it is known that the touching in the verse, according to the correct view, means: intercourse, and the meaning is not touching by hand. So touching by hand does not invalidate the ablution, and likewise touching other than the hand: such as the foot, or the mouth by kissing, does not invalidate the ablution according to the correct view. Yes.
