There is a difference of opinion among the scholars regarding touching a woman: some said it invalidates the ablution, some said it does not invalidate the ablution, and some distinguished by saying: if he touches her with desire and pleasure, his ablution is invalidated, otherwise it is not. The correct view is that it does not invalidate the ablution in any case; touching a woman does not invalidate the ablution in any case. This is the correct view, this is the stronger position; because the original ruling is that the ablution is not invalidated by it; and because the Prophet (peace and blessings be upon him) used to kiss some of his wives, then pray without performing ablution, and he did not order the people to perform ablution from touching a woman. If touching her invalidated the ablution, he would have ordered the people to do so. Allah sent him as a teacher and a guide (peace and blessings be upon him), and Allah did not let him pass away until he had conveyed the clear message (peace and blessings be upon him). So if touching a woman invalidated the ablution, the Prophet (peace and blessings be upon him) would have clarified it.
As for the saying of Allah (Glorified and Exalted is He) regarding what necessitates ablution: [Al-Ma'idah: 6], the intended meaning is: intercourse. He said, the Exalted: [Al-Ma'idah: 6]. His saying, the Exalted: [Al-Ma'idah: 6], this includes the ablution for minor ritual impurity. His saying: [Al-Ma'idah: 6], this includes major ritual impurity, meaning: approaching women.
