Question:
One of the listening brothers, Mubarak Musa from Omdurman in Sudan, asks and says: A man intended to perform Hajj, and after he completed the travel procedures, and before he reached the Noble Makkah, he passed away to the mercy of Allah. Is he like one who performed Hajj? And do the heirs have to perform Hajj on his behalf?
The Shaykh: Repeat.
The presenter : He says: A man intended to perform Hajj, and after he completed the travel procedures, and before he reached the Noble Makkah, he passed away to the mercy of Allah. Is he like one who performed Hajj? And do the heirs have to perform Hajj on his behalf to complete his Hajj?
Answer:
If he died before entering the state of ihram, then Hajj is performed on his behalf, if he was able to perform Hajj, if he left an estate behind... if he was able to do so in his lifetime, then Hajj is performed on his behalf. But if he was poor, then Hajj is not obligatory upon him.
But if he had entered the state of ihram, but died during the state of ihram, then there is no Hajj upon him; because when a person died at 'Arafah, the Messenger of Allah (peace and blessings be upon him) said: He ordered that he be washed with water and sidr, and shrouded in his two garments, and forbade that he be touched with perfume, or that his head and face be covered. He said: Sunan an-Nasa'i 2713, and he was not ordered to complete the Hajj on his behalf. This indicates that the Hajj in which he entered the state of ihram suffices for him, and it is not completed on his behalf.
But if this man died before entering the state of ihram, then Hajj is performed on his behalf, and praise be to Allah, if he was wealthy in his lifetime and able to perform Hajj, Hajj is performed on his behalf from the estate. But if he was poor, then nothing is required of him. However, if some of his relatives, or some of his companions, perform Hajj on his behalf, may Allah reward them with good.
The presenter : May Allah reward you with good.
