The questioner says: In our town, there is a site that was an old cemetery. This cemetery was removed twenty-five or thirty years ago, and a large mosque was built on its land. What is the validity of our prayer in this mosque?
The answer: If it was removed in a manner that is permissible according to the Shari'ah, based on a scholarly ruling, and the graves were excavated and transferred to another location, then there is no harm, provided it was done in a manner that is permissible according to the Shari'ah. The site of the Prophet's (peace and blessings be upon him) mosque contained graves. When he intended to build the mosque, he ordered the graves to be excavated; the graves of the polytheists were dug up and removed. There were pits and ruins, which were leveled, and there was a place with only palm trees, which were cut down. Then he (peace and blessings be upon him) built his mosque. So, if the cemetery is in an unsuitable location, and the one in authority and the scholars see fit to excavate it and transfer the graves to a suitable location, then there is no harm in building a mosque or houses there for the sake of a legitimate Shari'ah interest. Yes.
