The Ruling on the Hadith: (The Disagreement of My Ummah is a Mercy)

Question:
Our brother says: It reached me from the Messenger of Allah (peace and blessings be upon him) that he said: Is this authentic?

Answer:
It is not authentic; it is not from the words of the Prophet (peace and blessings be upon him). It is only from the words of some of the Tabi'un (the generation after the Companions). The Prophet (peace and blessings be upon him) did not say this. Some of the Tabi'un said: "I do not see the Companions of the Prophet (peace and blessings be upon him) disagreeing except as a mercy from Allah," meaning: so that the mujtahid (scholar qualified to derive rulings) may look and reflect upon the evidence. Thus, disagreement among scholars contains benefits for the Muslims, even though agreement is better and more excellent. Agreement contains mercy and good, as Allah (Exalted and Majestic is He) said: [Hud: 118-119]. So mercy is with the group, but if there is a matter in which there is disagreement among scholars, the scholar must look at the evidence and strive to prefer the opinion supported by the evidence. He must not be lenient in this matter, nor follow his desires. Rather, he must look at the Shari'ah evidence, and whatever he finds to be stronger in the evidence as being what is intended in the Shari'ah, he acts upon it, whether the matter has two, three, or four opinions. He seeks out the Shari'ah evidence from the verses and hadiths, and looks with the eye of insight, free from desire and bias. So whenever he finds one of the opinions, or one of the three, to be stronger, he takes it. Yes.
