Question:
This is a message received from Sudan from al-Tayyib Musa. He says: We have a mosque near the graveyards, about fifty meters away. One of the worshippers refused to pray in this mosque due to the hadith that says:
Do not make your mosques into graveyardsلا تجعلوا مساجدكم مقابر
We ask you to provide us with the ruling?

Answer:
If the mosque is on land that does not contain graves, and there is a barrier between it and the graves in the form of a road or a wall, then there is no harm, praise be to Allah. Graveyards are not to be made into mosques. The Prophet (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
, and he said (peace and blessings be upon him):
Do not pray toward graves and do not sit on them.لا تصلوا إلى القبور ولا تجلسوا عليها

. So if it is outside the graveyard, and its qiblah is not toward them, but rather there is a wall or a road between it and them, then there is no blame in that...
