Question:
The questioner says: I am a woman who became pregnant, and in the third month plus a week, the fetus was miscarried. I did not know the type of fetus it was. Some people told me: You must name this fetus and slaughter an animal for it. I did not know the ruling at that time, and I did not do anything. So what do you advise me to do? Is naming obligatory in the situation described? Is slaughter obligatory? May Allah reward you with good.

Answer:
If the fetus was miscarried before four months, it is not named and it has no 'aqiqah. The 'aqiqah and naming are only for one who is miscarried in the fifth month or after, from among those in whom the soul has been breathed; because it becomes a human being with the ruling of the fully formed, so an animal is slaughtered for it, it is named, it is washed, and the funeral prayer is performed for it if it is miscarried in the fifth month or after, after the soul has been breathed into it.
As for what is miscarried in the fourth or third month, it does not have the ruling of the fully formed. However, if the formation is distinct in it, meaning that the attributes of a human being have become apparent in it, such as a head, a hand, a leg, or the like, then the mother has the ruling of post-natal bleeding: she does not pray and she does not fast. As for the fetus itself, it does not have the ruling of the dead, nor does it have the ruling of the unborn; rather, it is buried in any place and that is sufficient. It is not washed and the funeral prayer is not performed for it; because it does not become a human being and it does not have the ruling of the dead, except if the soul has been breathed into it in the fifth month or after.
As for if it dies in the fourth or third month, if it is miscarried in the fourth or third month, it is only a piece of flesh in which the creation of the human being has become apparent, such as a head or a leg or the like. Then she does not pray and she does not fast. The duration of post-natal bleeding is forty days or less. When she becomes pure within the forty days, she prays and fasts. If the forty days are completed, she takes a full ritual bath and prays, even if she has blood. Her blood becomes blood of corruption. After the forty days, it is blood of corruption. She prays and fasts and performs the ablution for every prayer, like the woman with irregular bleeding.
As for if she becomes pure within the forty days, then she takes a full ritual bath and prays and fasts, and she is lawful for her husband.

She must pray and fast, and she is lawful for her husband. She performs the ablution for every prayer if she has blood.
