Fatwa No. ( 16210 )
Q: I got married, then my wife became pregnant and gave birth to a son, who is my first child. After about five months of breastfeeding, she became pregnant with the second son, but she miscarried in the fourth month. I threw it in the bathroom because I was ignorant of the Islamic rulings. I ask your Eminence to inform me of the Islamic rulings that apply to this. I have deeply regretted what I did, and I am now repentant to Allah. Please inform us, may Allah reward you with good.
A: If the situation is as described in the question, then if the pregnancy reaches four months and then miscarries, it must be washed, shrouded, and prayed over, because the soul has been breathed into it after this period. Therefore, what you did by throwing it in the bathroom was a wrong action. You must repent, seek forgiveness, and be careful in your religious matters by asking the people of knowledge. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
