Ruling on taking zakah for one who is not eligible to receive it
Machine translationRead the Arabic original
This letter or this manuscript reached us from the listener, Muslih ibn 'Abd al-Mu'in al-Kharmani al-Harbi, from Wadi Qudayd al-Baraykah. He has compiled in it more than seventy questions in twenty-eight pages.
We say to our brother Muslih that we apologize for answering all these questions, because they require a long time, and they will come from the listeners. So, you should follow the program, and you will get the answers to them, if Allah wills, especially since the listener hopes to send them by mail as well.
Among the questions of the listener Muslih, he says: Is it permissible for a person who is not eligible to receive zakah to take it?
Answer: If a man is not eligible to receive zakah, it is forbidden for him to take it. Even if he intends to give it to someone else, he has no right to take it except with the permission of its owner. If he says, "I want to give it to poor people," the owner may appoint him as an agent for that. This falls under the category of agency. However, if he takes it claiming to be poor, but his intention is to give it to someone else, that is not allowed. It is obligatory for him not to take it unless he is eligible for it, except if it is in the capacity of agency to pay it to poor people. In that case, he should be explicit with the zakah owner about this and inform him, so that the owner may appoint him as an agent or not. Yes.
