Question: This question is from the sister Hayat Muhammad Adam Silani, who says: Is it obligatory to offer a sacrificial animal for one who entered the state of ihram at the miqat and exited the state of ihram in the middle of the road because of an excuse that befall him, meaning: his car was broken, he repaired it, then he returned to the miqat, entered the state of ihram, and completed his rites?

Answer:
This is considered in the ruling of the one who is prevented (muhsar) who entered the state of ihram, then a defect occurred in the car, and he feared that his stay would be prolonged and would be difficult for him, so he exited the state of ihram. This is in the ruling of the one who is prevented, according to the correct opinion. He owes a sacrificial animal; he has to slaughter a sacrificial animal, offer a hady, and shave his head. He exits the state of ihram if he does not endure, if there is hardship for him in enduring, as Allah the Exalted and Majestic said:
But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals. And do not shave your heads until the sacrificial animal has reached its place of slaughterفَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ وَلا تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ
[Surat al-Baqarah: 196]
So if he is prevented and it is not easy for him to endure, he slaughters a hady, then shaves his head and exits the state of ihram. He repeats the Hajj if it was a Hajj, meaning the obligatory one; if it was the obligatory Hajj, he repeats it, or the 'Umrah if it was obligatory. And if it was voluntary, he owes nothing; because the Prophet (peace and blessings be upon him), when he was prevented in the year of Hudaybiyyah, when he was prevented, he and his companions slaughtered their sacrifices, then they shaved and exited the state of ihram in the sixth year of the Hijrah.
So if it becomes easy for him to return and enter the state of ihram from the miqat after that, this is another act of worship. If he returns and enters the state of ihram from the miqat, this is another act of worship, and it is not obligatory for him if he has already performed the obligatory one. If he has already performed the obligatory Hajj or the obligatory 'Umrah, it is not obligatory for him; but if he does that out of recommendation, that is good. The Messenger (peace and blessings be upon him), when he made a truce with the people of Makkah and slaughtered his hady and shaved, came to them the following year... -it was called: 'Umrat al-Qada'- and he and his companions performed the prescribed 'Umrah in the seventh year of the Hijrah; but the scholars said: this 'Umrah is not obligatory, but it is recommended; because the Messenger (peace and blessings be upon him) did not oblige those who exited the state of ihram with him at Hudaybiyyah to perform 'Umrah.

In conclusion: That being prevented (ihsar) does not obligate making up the missed act. So the one who has already performed a previous 'Umrah has performed the 'Umrah, and the one who has not performed a 'Umrah performs a 'Umrah... the obligatory one. And likewise, if one is prevented in Hajj, if he has already performed the obligatory Hajj, it is not obligatory for him to repeat the Hajj from which he was prevented. And if he has not performed the obligatory Hajj, he performs Hajj after... again, for the sake of the obligatory one, not for the sake of the prevention that befall him.

In conclusion: That this woman or man who was prevented due to the breakdown of the car, if he hastens and exits the state of ihram, he has the ruling of the one who is prevented if he intended to exit the state of ihram. He owes the expiation; one sacrificial animal, and he has to shave his head after that. Yes.
