The Ruling on the Marriage of Shighar

Machine translationRead the Arabic original
Question:
He says: If the parents propose to their son that he marry his cousin’s daughter, and he refuses for fear that it might be shighar, because one of his cousins is married to his sister, is this considered undutifulness to the parents?

Answer:
It is not befitting for him to refuse. I say: It is not befitting for him to refuse his parents’ words. This is not shighar, as long as his cousin has already married and the matter was concluded without any condition. Therefore, this is not shighar. And if you propose to marry one of your cousins’ daughters, and you have already married your daughters to them, there is no harm in that. Shighar is when it is a condition between you and them: “Marry me, and I will marry you.” But if he proposes to you, and you marry him without any condition, and then it occurs to you to propose to him, that does no harm.
