Question:
The first message in this episode is from one of our brother listeners. The sender is Yahya al-Hakim from the Republic of Sudan. The brother, Yahya, has a somewhat long question. He says: I divorced my wife with one pronouncement of divorce. I was angry because she did not respect me and because she insulted my father. I said to her, “You are divorced.” This is the first time in our marriage, which has lasted fifteen months so far. However, after reviewing the situation, it became clear that she was menstruating. I had not had intercourse with her for several days because she was with her sick father. I have heard, O Shaykh, that scholars such as Ibn Taymiyyah and Ibn al-Qayyim hold that such a divorce does not take effect because it was not in accordance with the Book of Allah and the pure Sunnah of the Prophet. I asked some Muslim scholars in Sudan, and they permitted the divorce to take effect. But now, O Shaykh, I seek help from Allah, then from you, to know your opinion on what I did, after seeking help from the Mighty Allah. May Allah reward you with good. Guide me and advise me on how to proceed? May Allah guide you and accept from you.
