What is the ruling on a contract of two sales in one sale?

The questioner : Now, Abu 'Ammar asked me a question. I said to him, "May Allah reward you," after the question was presented. Now, of course, we are presenting it, but I am offering a preamble, a way back, so to speak. He said: A man was compelled to buy tires for his car on installment, involving two sales in one sale. Is that permissible for him? I spoke at length about what the necessity is, where the dire necessity lies, and so on. He said, "My brother, suppose he was compelled." I said to him, "Between you and me, Abu 'Ammar, in my opinion, there is no dire necessity, because if we were to look for several solutions to get out of this dire necessity, one of the brothers who was present said, 'My brother, buy used instead of buying new.' Leave it like that, meaning there are many ways. He said, 'My brother... but if he was compelled, and all of this was closed off, and he cannot do without this car, and there is no alternative, is it permissible for him to buy on installment?' So what is your opinion, may you be respected, our Shaykh?

The Shaykh : My opinion is that I will not answer him in his way.

The questioner : Very good.

The Shaykh : I will answer him in my way.

The questioner: Yes.

The Shaykh : Like this one who is compelled to buy a car.

The questioner: Yes.

Another questioner: Peace be upon you.

The questioner: And upon you peace.

The Shaykh : And peace be upon you. Is he compelled to buy a car on installment?!

The questioner : He is not compelled at all, of course.

The Shaykh : This is even more so.

The questioner: Yes.

The Shaykh : He is not compelled.

The questioner : Yes, by Allah, if the car's tires are the issue, it is even more so.
