Question:
The questioner Ahmad Ayn from the Republic of Egypt, Fayyum, says: What is the ruling in the Shari'ah, in your view—Shaykh—on moving the bones of a deceased person from one place to another for the purpose of building the grave from mud brick to red brick? Please inform us, and may you be rewarded.

Answer:
This is not prescribed. As long as the deceased has been buried in the manner prescribed by the Shari'ah, praise be to Allah, there is no need to dig him up, and there is no need to change the brick from one type to another. However, if he was buried in a place that is not suitable, such as on a road, or in a place where floods come, or something similar, he is moved from that place to the public cemetery, to a place far from danger, in the manner in which people are usually buried. He is placed in his grave, bricks are placed over him, and then soil is heaped over him, just as with other deceased people. As for digging him up in order to change the bricks, or to change something else, this has no basis. Rather, he is left in his current state. Yes.
