Question:
From Zarqa in the Hashemite Kingdom of Jordan, this is a letter sent by a brother of ours from there. The sender (J.A.S.), our brother, included a case in his letter, stating: My wife was divorced, and she and her family desired this divorce. There was a baby girl between me and my wife, and she was three months old. The judge did not rule on maintenance for the child or her mother, but the judge ruled that my daughter be returned to me so that my mother could take custody of her. My mother took the little girl and kept her for several days. After that, my eldest brother objected to this situation on the grounds that my mother could not keep the girl any longer, and we returned our daughter to her mother. I then married another woman. Six years have passed since the divorce of the first wife, and she also married another husband, then was divorced from him. The child is still in her custody and is now in the first grade of primary school. I wanted to take the girl back to me, but my brother said that they do not want to bring the child to my house for fear for her safety regarding my second wife. My wife said that she is ready to take custody of her at any time. My brothers told me that I am responsible for the child and that I must send her maintenance. My question, O honorable Shaykh, is: Am I obligated to send her maintenance, even though the judge did not rule on that? Do I bear any sin? And what is the position of my brothers toward me? May Allah reward you with good.
