Question:
The questioner: His Eminence the Shaykh, I actually have a letter in front of me, from a doctor and lecturer in the Faculty of Medicine. She said: I hope it will be presented to His Eminence the Shaykh. The letter is actually long, and it contains a set of questions. She says: His Eminence the Shaykh, may Allah preserve you, she mentions that she is a married woman, for about five years, and she has a daughter. She says: At the time of marriage, my father imposed a condition on my husband, and wrote conditions in the contract, that I complete my higher studies, since she is a doctor and a lecturer in the Faculty of Medicine, and that she work before and after her studies, and the husband agreed to that during the period of her studies. She says: I used to spend on myself, my home, and my daughter, and I did not burden my husband with my expenses, in recognition of his standing by my side, even though I would have preferred if his job had been transferred to where I am; because the responsibility of life is difficult, especially with the studies. But now my husband considers that my spending on myself is obligatory, and my maintenance of myself, my daughter, and the house I live in, in all aspects, is my responsibility; because I am not with him, even though I do not agree, but I have no objection. The question, O His Eminence the Shaykh, she says: Does my husband’s agreement from the beginning of the marriage that I study give him the right to leave his responsibility? Or the responsibility of the home, financially and morally, on me on the pretext that I am not with him, even though it is supposed to be he who is responsible, and that he be with me; because he agreed to my completing my studies in an area other than my work area, due to the absence of a university offering higher studies there?

Answer:
The husband’s agreement to your completing your studies does not drop the maintenance from him. He is responsible for the maintenance of the house, and he is responsible for your maintenance, and your wealth is yours, and your livelihood is yours. But if you allow him the livelihood, or part of it, or the maintenance of the house, or the maintenance of yourself; there is no harm; because Allah the Exalted says:
But if they give up willingly to you anything of it, then take it in satisfaction and ease.فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا
[al-Nisa:4] regarding the wives. So if you forgive him, that is better; so that the companionship between you remains, and the affection between you remains. So if you help him with the maintenance of your house, or of yourself; it is all good. Otherwise, the obligatory maintenance is upon him. Yes.
