Question:
Our sister asks and says: If a man sees a woman who is uncovered without intending to, and she is in the period of mourning for a deceased person (her husband), what does this entail for her? Does she have to repeat the mourning?
Answer:
If a man sees a woman who is uncovered, he must lower his gaze and turn his sight away from her. The Prophet (peace and blessings be upon him) was asked about the sudden glance, and he said:, and he said: Sunan Abi Dawud 2149Hasan (Al-Albani). The meaning is that there is no blame on him for the first glance which was accidental and not intended, but rather he encountered her at a door as she was coming out, or at a door as he was going in, or on a path; so he turns his gaze away and does not follow the glance with another, but rather he lowers his gaze.
As for the woman in mourning and other women, there is nothing required of her in this if she does not follow the glance with another, but rather she covers herself and veils herself. She does not have to repeat what has passed of the mourning, but rather she continues in her mourning and there is nothing required of her, except that it is obligatory for her to stay away from the causes of fitnah (trial, discord or temptation) and to veil herself from foreign men, just like other women, equally. This is not specific to the woman in mourning, but she is like other women; she must veil herself and stay away from the causes of fitnah. She must observe, and the woman in mourning must observe five matters:
The first matter: her remaining in the house in which her husband died and in which she was residing, if it is suitable for her to remain in it. As for if it is not feasible for her to remain in it, due to its ruin, or because his family refused to rent it to her after the rent was completed, or because she has no one to comfort her in it after her husband's death and she fears for herself; she goes out to her family or to a safe place.
The second condition: that she wears ordinary clothes without clothes that cause fitnah (trial, discord or temptation). So she does not wear beautiful clothes, but rather she seeks out clothes that do not cause fitnah, which are ordinary clothes of black or green or other colors, but there is nothing in them that causes fitnah for people.
The third: avoiding jewelry of gold, silver, diamonds, and the like.
The fourth: not using perfume, incense, and other types of perfume; because the Messenger (peace and blessings be upon him) prohibited that, he prohibited the woman in mourning from that, may Allah's prayers and blessings be upon him.
The fifth: not using kohl and henna and the like; because that is also from the causes of fitnah (trial, discord or temptation).
So these five matters are prescribed for the woman in mourning to take care of, indeed it is obligatory for her to do so. As for what is other than that, she is like the rest of the women; she may take a ghusl (the full ritual bath) and wash her hair whenever she wishes, on Friday and other days. She may change her clothes whenever she wishes. She may speak to whom she wishes of the women and men, directly or by telephone, or by correspondence; there is no blame in that if the conversation does not contain fitnah (trial, discord or temptation) or suspicion, but rather she speaks for her need, and returns the greeting to whoever greets her, and the like of that in a manner that does not contain fitnah and does not contain shubhah (a doubtful matter). Yes.
