The ruling on delegating the stoning of the pillars to another out of fear of the crowd

Machine translationRead the Arabic original
Question:
The listener, Musa Ahmad from al-Mukhayya, sent a message saying: Last year, he performed the obligatory Hajj with his family. He performed the stoning of the pillars on behalf of his wife, who is a woman of middle age. There is nothing preventing her from performing it herself except the fear of the crowd...

The Shaykh: Repeat.

The presenter: He says: Last year, he performed the obligatory Hajj with his family, so he performed the stoning of the pillars on behalf of his wife, who is a woman of middle age. There is nothing preventing her from performing it herself except the fear of the crowd—he means the crowding of men—but he heard in one of the episodes of this program that the one who delegates while being capable of stoning the pillars must slaughter a sheep. He asks: Is the Hajj complete, or is it obligatory to slaughter a sheep? And if slaughtering is obligatory, is it permissible to send it to Mina to be slaughtered next year? Or should he slaughter it in his hometown and give it in charity? May Allah reward you with good.

Answer:
If she has no impediment other than the mere fear of the crowd, then he must expiate for her by slaughtering a sheep in Mecca at the present time. There is no need to slaughter it in Mina; rather, he sends it to... he appoints someone to slaughter it there in Mecca and distribute it to the poor, and that is sufficient, and praise be to Allah. However, if she has an ailment—because she is heavy and fears for her safety, or is ill, or something similar to those ailments for which one fears for her—then there is nothing required in that, and the Hajj is valid in all cases. The Hajj is valid in all cases. The only question is whether there is a deficiency due to the lack of stoning or not? If she has no legal impediment, then there is a deficiency that is compensated by the blood (sacrifice) that is slaughtered in Mecca and distributed to the poor. This is compensation for the deficiency that occurred due to the delegation that has no legal justification. Yes.

The presenter: May Allah reward you with good.
