Ruling on the Heirs’ Agreement Not to Divide the Estate
Machine translationRead the Arabic original
Question:
Our brother (A. A.) from Libya has another question regarding inheritance. He asks: Is it permissible for the heirs to agree not to divide the inheritance? Or is that not permissible?
Answer:
If the heirs are of sound mind and they agree to leave the estate as it is, and one of them or another agent takes charge of it to manage and grow it—for example, if the estate is a farm, one of them can oversee it, or they can appoint someone to care for it; or if the estate is a building that is rented out, they can collect the rent through an agent or through one of them—all of this is permissible if they are of sound mind. Likewise, if it is money and they place it with one of them to manage and trade in it, there is nothing wrong with that. The money is theirs, so if they agree on something while they are of sound mind, there is nothing wrong with it. Yes.
