Agreement of the Heirs on Disposing of the Inheritance
Machine translationRead the Arabic original
The first question of Fatwa No. ( 18776 )
Q1: Our father passed away and left behind only a house. A group of workers reside in this house and pay us a sum of money every month. Our family is large, and we have no source of livelihood except these funds. Is it permissible for us to subsist on these funds? And if we are required to divide it among ourselves through inheritance, should we sell this house or not?
A1: If the matter is as described, then after settling your father’s debt, if there is any, and then executing his lawful bequest, if there is any, the remainder of the rent belongs to his lawful heirs. It is to be divided according to the lawful division. It is good for you to agree to sell the house or lease it out; do whatever is most beneficial for you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
