Q1: My father’s mother had a sum of seven hundred riyals with her. After her death, my father collected this amount and said that he would distribute it to the poor and the needy. He decided to gather his brothers and consult them on this matter. If they do not agree with my father’s proposal, what should he do? Note that my father is the youngest of his three brothers.
A1: The money that your father’s mother left behind is an estate for her heirs after
settling her debts and executing her bequest, if any. If all the heirs, or some of them, and they are of sound mind, waive their share of the estate, it belongs to the person to whom they waived it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
