The Obligation to Fulfill the Conditions in the Marriage Contract
Machine translationRead the Arabic original
Question:
This questioner (A. A. A.) from the south says—Your Eminence, the Shaykh: A young woman is about to get married, and she is a teacher. One of the conditions in the contract is that she has free disposal of her salary. She fears future disagreement over the matter of the salary, and she wishes to give her family some of this salary, while keeping some for her husband. Is she being fair in that? And is it sufficient for her to give her husband only one thousand riyals, and would that be considered fair?
Answer:
This concerns the matter between her, her family, and her husband. She is free with her salary. If there are conditions between her and the husband that she will not work, or that she will give him half of the salary, then they are bound by their conditions at the time of the contract. The Prophet (peace and blessings be upon him) said: Or if he allowed her and did not take anything from her salary, there is no harm. Likewise, with her father and mother, the matter is between them and does not extend beyond them; if they agree on something, there is no blame.
