We conclude this session, O Shaykh, with this question. It says: Regarding a bequest that contradicts the Shari'ah, is it carried out or not? And how does the beneficiary of the bequest handle this bequest?

Answer:
Bequests that contradict the Shari'ah are not carried out. If bequests contradict the Shari'ah, they are not carried out; only what conforms to the Shari'ah is executed. For example, if a person bequeaths more than one-third of his wealth, only the one-third is executed, unless the mature heirs consent to the increase. If he bequeaths wealth for a sin, such as buying intoxicants or buying some of the instruments of amusement, the bequest is not carried out. Likewise, the bequest must conform to the Shari'ah. The bequest must be in accordance with the Shari'ah. If he bequeaths to the heirs, or to some of the heirs, there is no bequest for an heir. The bequest must be in conformity with the Shari'ah, in accordance with the Shari'ah.
