Question:
This is a questioner for the program who has used the initials (A. A) as a code for his name. He says: I have two brothers who do not pray. Their character is bad with everyone, even with their father and mother. They are isolated from us, so they do not mix with us. What is the ruling on me and my brothers cutting off contact with them? May Allah reward you with good, O Shaykh.

Answer:
If your two brothers do not pray, then it is obligatory to advise them and to strive to guide them to good. Your father must strive to advise them, and you must do so with him, perhaps Allah will guide them through your efforts. If your father is able to discipline them, he should discipline them. The Prophet (peace and blessings be upon him) said:
Order your children to pray at seven years of age, and beat them for it at tenمروا أولادكم بالصلاة لسبع، واضربوهم عليها لعشر
Sunan ad-Daraqutni 3:5
If a boy of ten is beaten, then an adult is beaten. If he repents, otherwise he is killed.
If your father is unable to do so, and you are unable to do so, then refer the matter to the Commission or to the court so that the command of Allah is established against them. The one who does not pray is given the opportunity to repent; if he repents, otherwise he is killed. The Prophet (peace and blessings be upon him) said in the authentic hadith:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل، وبين الكفر والشرك ترك الصلاة
And he (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها؛ فقد كفر

And he (peace and blessings be upon him) said:
I have been prohibited from killing people who prayنهيت عن قتل المصلين

This indicates that the one who does not pray is killed. And Allah (Exalted and Majestic is He) says:
But if they should repent, establish prayer, and give zakah, let them [go] on their wayفَإِنْ تَابُوا وَأَقَامُوا الصَّلاةَ وَآتَوُا الزَّكَاةَ فَخَلُّوا سَبِيلَهُم
[At-Tawbah: 5]. This indicates that the one who does not perform prayer is not left alone, but is killed. And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل، وبين الكفر والشرك ترك الصلاة
And he (peace and blessings be upon him) said:
The head of the matter is Islam, and its pillar is the Salatرأس الأمر الإسلام، وعموده الصلاة

If they reform, otherwise refer their matter to the Commission so that they are disciplined, perhaps they will pray. If they do not pray, they are referred to the court so that the ruling of Allah is carried out against them by giving them the opportunity to repent; if they repent, otherwise they are killed.
