The nature of breastfeeding that results in prohibition
Machine translationRead the Arabic original
Question:
The listener Taha Sayyid Ahmad, residing in Ta'if, of Egyptian nationality, sent a question, saying: My mother breastfed an infant, and the breastfeeding was just a few drops in the infant's mouth, not exceeding three feedings. Is it permissible for my younger brother to marry the daughter of this breastfed infant?
Answer:
The breastfeeding that results in prohibition must be five feedings or more, each feeding being distinct. The milk must be given, or dropped into his throat until it reaches his stomach from the woman, once after another, five times or more, or by the breast—sucking from the breast—or from an artificial breast, where it is poured into the breast and then he sucks from the device five times or more. This is what results in prohibition, and the breastfed infant becomes a son to the wet nurse, a son to her husband, and a brother to her children.
If the breastfeeding is three times, or less, or four times, it does not result in prohibition, and there is no harm in the marriage, whether marrying her daughter from the woman's children, or her husband's children, or the daughter of this man, or the daughter of his daughter, or the daughter of his son; because this breastfeeding is not the Shari'ah breastfeeding that results in prohibition. However, leaving it off is good, as a precaution against doubt, because some scholars prohibit marriage based on three feedings. So if a person leaves it off due to the saying of the Prophet (peace and blessings be upon him):Bulugh al-Maram 16:32 and his saying (peace and blessings be upon him): Sunan an-Nasa'i 5711Sahih (Darussalam) and his saying (peace and blessings be upon him): Jami` at-Tirmidhi 2389Sahih (Darussalam) this is a matter of caution. Leaving it off is preferable, and leaving off the marriage is preferable after the existence of the aforementioned breastfeeding, whether three times, two times, or once. Leaving off the marriage is preferable because it is a doubtful matter, as some scholars prohibit marriage based on one feeding, and prohibit it based on three feedings, due to the general wording of some hadiths and the noble verse [Al-Nisa: 23].
But the correct view, which is the position of the majority of scholars, is that it must be five feedings or more. This is the correct view, within the two years before weaning, before the completion of the two years. If the breastfeeding is after the two years, and the child is older, the breastfeeding does not benefit and does not affect the ruling, according to the correct view. Likewise, if the breastfeeding is less than five times, it does not affect the ruling and does not result in prohibition. This is the correct view, and success is from Allah.
