Question:
What is the ruling on one who swears by other than Allah, circumambulates graves, and practices acts of shirk (associating partners with Allah), but is ignorant?

Answer:
He is to be taught. He is a mushrik (one who associates partners with Allah) and is to be taught, like the mushrikin (those who associate partners with Allah) of the jahiliyyah (the pre-Islamic age of ignorance). He is commanded to repent until he does so.
Q: And if he dies in that state, is he a mushrik (one who associates partners with Allah)?
A: If he worshipped the graves, he dies a mushrik (one who associates partners with Allah). He is not to be prayed over, not washed, and not buried with the Muslims.
Q: Even if he was ignorant?
A: Even if he was ignorant, the worshippers of al-Badawi and their like are kafirun (disbelievers).
