Q: A man says that some of the Islamic legal rulings need to be reconsidered and that they need to be modified because they do not suit the development of this age. For example, the inheritance ruling that the male’s share is equal to the female’s share. What is the ruling in the Shari'ah regarding one who says such things?

A: The rulings that Allah has legislated for His servants and explained in His Noble Book or on the tongue of His trustworthy Messenger (peace and blessings be upon him), such as the rulings of inheritance, the five prayers, zakah, fasting, and the like of what Allah has clarified for His servants and upon which the Muslim community has reached consensus, no one has the right to object to them or change them. This is because it is a perfect legislation for the community in the time of the Prophet (peace and blessings be upon him) and after him until the Hour. Included in this is the preference of the male over the female among children, the children of sons, and brothers on the part of both parents or on the part of the father. This is because Allah (Glorified and Exalted is He) has clarified it in His Noble Book and the scholars of the Muslims have reached consensus upon it.
Therefore, it is obligatory to act upon this with belief and faith. Whoever claims that what is better is contrary to it is a disbeliever. Likewise, whoever permits its contradiction is considered a disbeliever. This is because he is objecting to Allah (Glorified and Exalted is He), to His Messenger (peace and blessings be upon him), and to the consensus of the community.
And the one in authority should call him to repent if he is a Muslim. If he repents, well and good; otherwise, it is obligatory to kill him as a disbeliever who has apostatized from Islam. This is based on the saying of the Prophet (peace and blessings be upon him):
Whoever changes his religion, execute him.من بدل دينه فاقتلوه
