Q: A man says that some of the sacred laws need to be reconsidered and that they require modification because they do not suit the development of this era. An example of this is the inheritance ruling that the male’s share is equal to the female’s share. What is the ruling in the Shari'ah regarding one who says such things?

A: The rulings that Allah legislated for His servants and clarified in His Noble Book or on the tongue of His trustworthy Messenger (peace and blessings be upon him), such as the rulings of inheritance, the five daily prayers, zakah, fasting, and the like of what Allah has clarified for His servants and upon which the Muslim community has reached consensus, are not to be objected to or changed by anyone. This is because it is a decisive legislation for the community in the time of the Prophet (peace and blessings be upon him) and after him until the Hour. Included in this is the preference of the male over the female among children, the children of sons, and brothers on the part of both parents or on the part of the father. This is because Allah (Glorified and Exalted is He) has clarified it in His Noble Book and the scholars of the Muslims have reached consensus upon it. It is obligatory to act upon this with belief and faith. Whoever claims that what is better is contrary to this is a disbeliever. Likewise, whoever permits its contradiction is considered a disbeliever, because he is objecting to Allah (Glorified and Exalted is He), His Messenger (peace and blessings be upon him), the consensus of the community, and the one in authority. The one in authority must call him to repent if he is a Muslim. If he repents, well and good; otherwise, it is obligatory to kill him as a disbeliever who has apostatized from Islam, based on the saying of the Prophet (peace and blessings be upon him):
Whoever changes his religion, execute him.من بدل دينه فاقتلوه
