Question:
This is your sister in Allah (H. M. H) who wrote a set of questions in her own style, saying: Your Eminence, a woman is married to a man who does not provide for her or her children the most basic necessities of life. He works one day and rests for a week, and the children have become like orphans; the neighbors give them charity, and anyone who sees their condition feels pity for them and offers them charity. She says: She advises him and demands that he meet the needs of the house and the children, but there is no response to her calls. So she and he are in constant conflict. She also mentions, Your Eminence, that she says: I do not serve him; do I sin in that? And should I ask about my dealings with him before Allah ?

Answer:
O questioner, you have the choice. If you are patient, there is no harm. If you are not patient, take the matter to the court. You may ask for divorce because he does not fulfill his obligation. If you are patient and cooperate with him, there is no blame on you. You are not required to obey him in what you cannot do, such as the times when you must seek provision for your children. As for the times when you can, respond to his needs. If he asks for you at a time when you cannot respond, you are excused. Allah says:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[al-Taghabun: 16]. So you must obey him in what you can, and there is no blame on you in what you cannot, such as the time for seeking provision for your children and yourself, because he does not provide maintenance. And the other times when illness or a valid legal excuse, such as menstruation or something similar, prevents you.
The point is: you must obey him according to your ability, in what Allah has made lawful and prescribed. And you may ask for separation and ask for divorce at the court, because he has not fulfilled his obligation. Yes.
