Question:
The first message in this episode is one that reached the program from the Republic of Djibouti, sent by one of the brother listeners from there. He says: Muhammad Ali Yusuf. Our brother has an introduction in his message from which we proceed to the question. He says: There are among the Muslims those who work as lawyers. The person who works as a lawyer sometimes defends the oppressor, and he knows that he is an oppressor. If you ask him: Why do you defend the oppressor? He says: This is my profession.
The question posed is: Is there such a thing as law in Islam? And what is the ruling of Islam regarding law and lawyers? Please inform us, may Allah reward you with good.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, upon his family and his Companions, and upon those who follow his guidance. As for what follows:
Law carries a great danger, and it is an agency in litigation on behalf of the person who appoints the agent. If the agent, who is the lawyer, seeks the truth, demands the truth, and strives to deliver the right to its rightful owner, and his being a lawyer does not lead him to support the oppressor, or to deceive the rulers and judges and the like; then there is no blame on him; because he is an agent.
As for if law leads him to support the oppressor and assist him against the oppressed, or to deceive in the lawsuit, or to seek false witnesses or something similar to that from falsehood, then it is forbidden, and its practitioner falls into the category of those who assist in sin and transgression.
It is authentic from the Messenger of Allah (peace and blessings be upon him) that he said:
Help your brother, whether he is an oppressor or he is an oppressed one.انصر أخاك ظالمًا أو مظلومًا
Sahih al-Bukhari 2443
. They said: O Messenger of Allah! I support my brother when he is oppressed, but how do I support him when he is the oppressor? He said:
You prevent him from oppressionتحجزه عن الظلم
meaning: you prevent him from oppression
That is your support of himفذلك نصرك إياه
. So this is supporting the oppressor: that he is prevented from oppression and not assisted in oppression.
So if the lawyer assists him in oppression, he is a partner with him in the sin, and his work is reprehensible, and he is exposed to the anger of Allah and His punishment. We ask Allah for safety. And so is every agent, even if he is not called a lawyer, even if he is called an agent. If he assists his client in oppression and transgression and in taking the rights of people by falsehood, he is a partner with him in the sin, and he is an oppressor just like his client. We ask Allah for everyone safety, guidance, and well-being.

The presenter: May Allah reward you with good. It is as if I see Your Eminence the Shaykh advising against engaging in this profession?

The Shaykh: Yes. I advise against engaging in it except for one who trusts himself that he seeks the Shari'ah, assists in establishing the Shari'ah, supports the oppressed, and does not assist the oppressor. As for if his soul inclines to taking money without right, and to supporting the one who appointed him and made him his lawyer; then it is not permissible for him, rather he must be cautious.
