Question:
A message was received for the program from one of the listening brothers. He says: Your brother is Jalal al-Din Abd al-‘Al, an Egyptian accountant working in Jeddah. Our brother has three questions. In his first question, he asks: Is taking a noble mushaf from one of the mosques to read in it, without anyone in the mosque knowing, considered theft? And how is the expiation for that if it is theft?

Answer:
It is not permissible for anyone to take from the mosque any of the mushafs placed there to his home or to his country. Rather, it must remain in the mosque. This is because the one who placed it in the mosque intended it for the benefit of the Muslims who come to the mosque to read in it as long as it is in the mosque. Then he places it in the mosque and does not take it out of the mosque, unless it is placed in a known location for distribution and its owners bring it for distribution and inform the mu’adhdhin or the imam that this is for distribution; then that is a different matter.
As for what is placed in the cupboards in the mosque or on the shelves in the mosque for the benefit of the mosque’s visitors and the worshippers in the mosque, no one is allowed to take it from the mosque. This is because the endower intended it to remain in the mosque. So whoever takes something from this, it is obligatory for him to return it. If it was destroyed or he lost it, he must replace it with its equivalent by buying its equivalent and placing it in the mosque in place of what he took from the mosque, along with repentance and seeking forgiveness. Yes.

The presenter: May Allah reward you with good. What is your advice, Your Eminence the Shaykh, for those in charge of the affairs of mosques, such as the mu’adhdhins and the servants? Do they allow anyone to borrow a mushaf from the mosque and then return it, or something similar to that?

The Shaykh: They do not have the right. No, it is not permissible for the imam or the mu’adhdhin to lend it out, unless the one who placed it in the mosque allowed them to do so. As for if he placed it in the mosque and did not allow them to do so, then they do not have the right to lend it to anyone. Yes.

The presenter: May Allah reward you with good. The expiation, our brother is asking about it?

Answer: He does not have an expiation other than repentance and seeking forgiveness, and that he return the mushaf as he took it, or return a substitute for it if it was lost on him or destroyed.

The presenter: You have done well. And this is its expiation?

The Shaykh: This is its expiation, yes, along with repentance.

The presenter: May Allah reward you with good.
