Question:
A letter arrived from Algeria. The questioner, whose name is symbolized by (H. B), says: Your Eminence, is the marriage contract valid if one of the spouses does not pray, or if both spouses do not pray? What is the ruling on marriage in such a case? May you be rewarded.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and peace upon the Messenger of Allah, and upon his family and his Companions, and upon whoever follows his guidance.
This matter is reviewed by the competent authorities, the court or the authorities competent to authorize marriage; because there is a detailed ruling in it. The one who prays is not permitted to marry a disbelieving woman who does not pray, and the one who prays and the suitor does not pray, she is not permitted to marry him; because Allah, Glorified and Exalted is He, says:
And do not marry polytheistic men [to your women] until they believeوَلا تُنكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا
[al-Baqarah: 221], and He says:
they are not lawful [wives] for them, nor are they lawful [husbands] for themلا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ
[al-Mumtahanah: 10]. So it is not permissible for a Muslim woman to marry a disbeliever, and it is not permissible for a disbeliever to marry a Muslim woman. Yes.
