Question:
A letter reached the program from listener Muhammad Saleh Naji from al-Khobar. Our brother has a set of questions. In his first question, he asks about the ruling on one who marries a girl who does not pray, or the reverse as well. What is the ruling on one who abandons prayer? And if he dies, is he prayed over and buried in the Muslim cemeteries?

Answer:
If a man marries a girl who does not pray while he prays, or the reverse: a girl who prays while he does not pray, then the marriage is invalid according to the correct view; the marriage is defective. This is because it is not permissible for a Muslim to marry a disbelieving woman, nor for a Muslim woman to marry a disbeliever. Abandoning prayer is disbelief according to the correct view; it is major shirk (associating partners with Allah). So if one of them prays and the other does not, the marriage is not valid. Rather, it must be renewed after the one who does not pray repents. If he repents, the marriage is renewed, if his partner desires it.
As for if they both do not pray, the original marriage is valid, like the marriage of disbelievers; it is a valid marriage. They must repent to Allah and return to the obedience of Allah and His Messenger, and their marriage is valid. Yes.
