The Ruling on the Marriage of One Who Does Not Pray

السؤال:
Our sister asks her final question in this session, saying: What is your opinion if the husband does not pray, or the wife does not pray while the husband does? What is required of the one who prays in the situation described?
May Allah reward you with good.

Answer:
If a man marries a woman, and it becomes apparent after the marriage that one of them does not pray, the marriage is annulled; because the one who does not pray is a disbeliever according to the correct opinion of the scholars, even if he does not deny the obligation, and even if it is out of laziness. Abandoning the prayer is major shirk (associating partners with Allah), may Allah protect us from it, according to the most correct of the scholars' opinions.
So if he does not pray, the marriage is annulled, or if she does not pray and he does, the marriage is annulled.
As for if they both do not pray, the marriage is valid, like the marriage of other disbelievers.
As for if one of them prays and the other does not, the marriage is annulled until the one who does not pray repents. And if he repents and returns, the marriage is renewed for him with her if she agrees to it.
And if it is she who does not pray, then if she repents and returns, the marriage is renewed for her with him if he desires it. The evidence for this is the saying of the Prophet (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
and his saying (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
