However, if it was intentional, he is subject to discretionary punishment in addition to the blood money. As for if it was by mistake, then only blood money is due. The Prophet (peace and blessings be upon him) said:
The Muslim is not killed for disbeliever.لا يُقتل مسلم بكافر
