The Ruling on Hiring a Disbelieving Female Servant and Mixing with Her

Machine translationRead the Arabic original
Question:
What is the ruling on mixing and being alone with the female servants working in many Muslim homes today? And is it permissible to hire a disbelieving female servant?

Answer:
The danger posed by female servants is great, and the calamity with them is severe. Therefore, it is not permissible to be alone with a non-mahram woman, whether a servant or anyone else. It is not permissible for a man to be alone with a servant, nor with his brother’s wife, nor with his paternal uncle’s wife, nor with his maternal uncle’s wife, nor with a female neighbor, nor with any other non-mahram woman.
The Prophet (peace and blessings be upon him) said:
No man should be alone with a woman, for Satan is the third among them.لا يخلونَّ رجلٌ بامرأةٍ، فإنَّ الشيطان ثالثهما
Al-Mustadrak lil-Hakim 2:94
, so he must not be alone with a woman who is not a mahram to him, whether a servant or anyone else. And he must not hire disbelieving male or female servants in this Peninsula. It is not permissible to bring non-Muslims into this Peninsula, whether men or women, except Muslims; because the Messenger (peace and blessings be upon him) ordered the disbelievers to be expelled from it, and he recommended that upon his death, and that only Islam should remain in it. It is the stronghold of Islam and the source of Islam, so it is not permissible to bring disbelievers into the Arabian Peninsula, in its entirety, length and breadth.
Nor should a person of sound mind be deceived by what people are doing today in hiring disbelievers; he should not be deceived by that. Yes, may Allah reward you. However, if the one in authority sees that dire necessity calls for it, such as the Muslims’ need for a doctor they are compelled to have, or a worker they are compelled to have, and the one in authority sees it to be in the interest of the Muslims, as the Prophet (peace and blessings be upon him) employed the Jews in Khaybar out of dire necessity for them, and then 'Umar (may Allah be pleased with him) expelled them , likewise, if they are brought in for the benefit of the Muslims without residing there: such as those brought in to sell goods, who sell their goods and then return after a specified period and limited days, the scholars have clarified this.
