Question:
One of the preachers reported from your eminence that it is permissible for the pilgrim to depart from Muzdalifah at night without an excuse or cause. Is this correct?

Answer:
The scholars have specified departing in the last part of the night, after the middle. However, the Sunnah is that one should not depart unless he is among the weak. If he is among the weak—such as women, children, the elderly, and the sick—the Sunnah for him is to depart before the people in the last part of the night.
As for the healthy and strong, the Sunnah for them is to remain until they depart after Fajr, after the light of dawn. It is not permissible for him to depart before that. The healthy person does not have the right to depart, nor does the non-healthy person before the middle of the night; rather, it is in the last part of the night. But the healthy person should remain until he prays Fajr and departs with the people before the light of dawn.
As for the sick, the elderly, women, and children, they depart in the last part of the night, in the latter half, and their brothers are with them, those who have brothers with them......
