Question:
The first letter in this episode is from listener Ali Muhammad Aamer Ali from Shubra in the Arab Republic of Egypt. Our brother began his letter by saying: Peace be upon you, and Allah’s mercy and blessings, and after that:
Islam has specified what follows from breastfeeding, and it has prohibited the marriage of siblings through breastfeeding by the explicit text of the Book and the Sunnah, which is known to us. However, in recent years, organ transplant operations have taken place, such as heart transplants and the like, as well as blood transfusion operations. What is the ruling on this in Islam? First: if the person to whom the blood or organ is transferred is of breastfeeding age?
Second: if the person to whom the blood or organ is to be transferred is older than breastfeeding age, and peace be upon you, and Allah’s mercy and blessings?
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
Allah (Exalted and Majestic is He) has clarified in His Noble Book, and on the tongue of His trustworthy Messenger Muhammad (peace and blessings be upon him), the rulings regarding those who are prohibited from marriage due to lineage, breastfeeding, and affinity. As for what concerns blood transfusion and organ transplantation, it does not fall under breastfeeding, nor is it of the same kind as breastfeeding. These are matters that are determined by divine text, and nothing is to be analogized to anything else in them. Rather, the matter of breastfeeding is by explicit text, and the matter of lineage is by explicit text, as is affinity. Therefore, blood transfusion and organ transplantation are not to be analogized to breastfeeding. If blood or an organ is transferred from Zayd to 'Amr, or from so-and-so to so-and-so, or from so-and-so to so-and-so, the ruling of breastfeeding is not established by it. If blood is transferred from a woman to a person, she does not become his mother, and her children do not become his siblings, and so on. It does not have the ruling of breastfeeding, neither blood transfusion nor organ transplantation. I am not aware of any disagreement among the scholars on this matter, because blood transfusion is not to be analogized to breastfeeding, neither within the two years nor after the two years.
Likewise, organ transplantation, such as a kidney or others, is not to be analogized to breastfeeding, because breastfeeding is a legislative matter that came from the Messenger of Allah (peace and blessings be upon him), and He made it like lineage. Therefore, nothing else is to be analogized to it. Rather, these are matters determined by divine text, and neither blood transfusion nor anything else is to be analogized to them. And Allah is the guarantor of success.
The presenter: May Allah reward you with good.
