The Lawful Breastfeeding That Establishes the Rulings of Breastfeeding
Machine translationRead the Arabic original
Question: Your presence, our noble Shaykh, the virtuous Shaykh/ Abdulaziz ibn Abdullah al-Baz (may Allah preserve him).
Peace be upon you, and Allah’s mercy and blessings, and after that:
I received your noble letter regarding the question of the brother: R. S. R. I called by phone the woman who is the wet nurse mentioned in his question, and I inquired of her after fully explaining what was intended.
Her answer was: that in only one of the three times, she is certain that the child did not separate from the breast during the breastfeeding. As for the other two times, she does not remember the matter at all now, and she does not know whether in either of them he separated from the breast and then returned to it, or whether he did not separate.
I repeated the question to her, and her answer was the same, without difference. Given that this situation was not mentioned in your letter, I wrote this and gave it to the questioner so that he may present it to you. May Allah preserve you and care for you. And peace be upon you and the mercy of Allah and His blessings.
Your lover: M. S. A.
Answer: From Abdulaziz ibn Abdullah ibn Baz, to the presence of the honored brother, the virtuous Shaykh/ M. S. A, may Allah grant him peace.
Peace be upon you, and the mercy of Allah and His blessings. After that:
O my lover: Your noble letter dated 28/2/1404 AH has arrived, may Allah guide you. I understood what your virtue indicated regarding the breastfeeding of: R. S. R. by his uncle’s wife, named (Q), for three breastfeedings, where the manner of his breastfeeding is not preserved in two of them.
Based on this, the sonship of: (R) is not established for the wet nurse (Q) mentioned, nor for her husband. And the daughters of the wet nurse (Q) are not forbidden to: (R) mentioned, nor are the daughters of her husband from another woman; because the lawful breastfeeding that establishes the rulings of breastfeeding is not established. This is based on what is established from Aisha (may Allah be pleased with her) who said: "It was among what was revealed in the Qur'an that ten known breastfeedings make a person forbidden, then they were abrogated by five known breastfeedings, and the Prophet (peace and blessings be upon him) passed away while the matter was still on that." It was narrated by Muslim in his Sahih, and al-Tirmidhi, and this is his wording.
So I hope you will inform everyone of the aforementioned fatwa. May Allah reward you.
And peace be upon you and the mercy of Allah and His blessings.
